What is Fair Housing Testing?

Fair housing testing is a structured method used to assess whether housing providers treat individuals equally under fair housing laws. Testing involves comparing the experiences of individuals who are alike in all relevant respects except for a protected characteristic under federal or state law. For example, two individuals may inquire about the same rental unit or home, following assigned scenarios, to determine whether they receive consistent information and treatment. Testing helps document patterns of treatment and supports enforcement of fair housing protections.

 

What is a Fair Housing Tester?

A Fair Housing Tester is a trained part-time employee who participates in structured testing assignments coordinated by the Fair Housing Center of Southwest Michigan. Testers pose as prospective renters or homebuyers and carefully document their interactions with housing providers. Testers do not conduct independent investigations or attempt to identify discrimination on their own. Instead, they follow detailed instructions and objectively record what occurs during housing inquiries. Testers play a critical role in supporting the enforcement of fair housing laws throughout Southwest Michigan.

 

Why is the role important?

Testing has long been recognized by the U.S. Supreme Court and federal courts as a legitimate and necessary tool for identifying unlawful housing discrimination. Because discrimination is often subtle and difficult to detect, testing provides a structured and reliable way to document how housing providers treat different individuals. The information gathered through testing may support administrative complaints, legal action, or policy change. Through testing, the Fair Housing Center of Southwest Michigan works to ensure equal access to housing for all individuals and families in our region.

Fair Housing Testers are individuals who:

  • Pay close attention to detail

  • Follow instructions precisely

  • Communicate clearly and professionally

  • Maintain confidentiality

  • Are comfortable participating in structured role-based assignments
     

A diverse pool of testers strengthens effective fair housing enforcement.
